Quest Diagnostics Reaches $13 Million Settlement Over Kickback Allegations
Quest Diagnostics has agreed to pay more than $13 million to resolve federal allegations that it provided illegal kickbacks to healthcare providers and executives. The allegations center around giving out New York Giants tickets and access to exclusive team events in exchange for referrals, the U.S. Attorney’s Office of New Jersey announced on Friday.
Alleged Illegal Kickbacks Involving NY Giants Tickets
According to U.S. Attorney Robert Frazer, Quest Diagnostics, a clinical laboratory operator headquartered in Secaucus, New Jersey, offered clients suite seats to Giants home games, as well as invitations to attend training camp and other exclusive events, in return for their business. These benefits were tied to a naming rights and sponsorship agreement Quest entered with the New York Giants in 2013, giving the laboratory operator access to home game suites at MetLife Stadium along with marketing and hospitality opportunities.
Violating the Anti-Kickback Statute
Federal prosecutors allege that between July 25, 2013, and August 3, 2022, Quest’s actions violated the Anti-Kickback Statute. This law prohibits providing or accepting anything of value to encourage the use of services or items paid for by Medicare, Medicaid, or other federally funded healthcare programs. Prosecutors claim that Quest not only provided free access to Giants games and related perks but also tracked the revenue generated from healthcare providers for up to a year after these events.
Healthcare Referrals and Lab Testing Billing
The settlement resolves claims that Quest Diagnostics submitted false claims for laboratory testing services to Medicare and to New York and New Jersey Medicaid programs. The payments made for lab tests referred by physicians who had received tickets or hospitality were at the center of the government’s concerns about medicare fraud and medicaid claims handling, officials said.
Corporate Integrity Agreement and Ongoing Compliance
As part of the settlement, Quest Diagnostics is required to enter a five-year corporate integrity agreement with the Department of Health and Human Services' Office of Inspector General. This agreement mandates that Quest secure an independent review organization to audit its operations, helping to prevent future violations of the anti kickback statute and ensuring compliance in lab testing billing connected to federal healthcare programs.
Quest Diagnostics’ Response
A spokesperson for Quest, Amanda Rivera, stated that the firm denies any wrongdoing or legal violations. However, Quest agreed to the settlement to resolve the matter and move forward. Rivera said the company has consistently demonstrated a commitment to regulatory compliance, and that since last year, information related to the settlement and corporate integrity agreement had been shared in Quest’s public filings. According to Rivera, the terms of the agreement closely mirror Quest’s existing compliance protocols.
New York Giants’ Involvement
The New York Giants organization, based in New Jersey, did not respond to requests for comment regarding their role in this case.
